RM240: Preliminary Injunction Denied in AWA Challenge

Tonight we talk about a long-time listener’s question about Wisconsin and Iowa registry laws. He is no longer on supervision but is required to wear a GPS monitor. The listener wants to move to Iowa to free himself from a GPS monitor, but because of Iowa’s registry laws, he might rid himself of the monitoring but have his time on the registry extended.

Then we discuss a recent ruling in a case out of California. ACSOL, or the Alliance for Constitutional Sex Offense Laws, sought an injunction challenging SORNA regulations. Laws that seek a preliminary injunction need to show a high likelihood of success on the merits and that there would be irreparable harm. The court also considers who has standing in a court case, and the Department of Justice argued that the plaintiff, John Doe, does not have standing.

Our show ends with a discussion about natural disasters and how PFRs are affected by limitations to evacuation shelters. Although a PFR might have standing if they filed a challenge, because of the number of agencies involved, the case might become a game of agencies pointing fingers at each other.
