Our team received a victory in Tennessee recently. The court made it clear that it only applies to him. They said that the state can’t enforce the registry against you. But they’re not going to order that he be removed from the public registration, which all throughout the opinion, the court recognizes how disastrous that is for the individual.

Welcome to Episode 125 of Registry Matters. It was significant to me in this episode that one of the Supreme Court Justices made an amazingly impactful statement. It was about the promise of our constitutionally promised liberties. We all expect to have certain unalienable rights guaranteed by the constitution. When you finish the terms of your parole and/or probation, you should have ALL of your rights restored. There should be no disabilities and restraints placed upon you. This means no markings on your drivers license, no living or work or presence restrictions. That’s what the passage meant to me. Our current climate allows for this civil regulatory scheme to reach its tentacles deep into controlling your life. And simply, it shouldn’t. You paid your debt to society.

We find ourselves here at episode 124 of Registry Matters. The Corona Virus is still a significant issue pushing into the criminal justice system. With much of it shut down, what remedies are there for people? Not just those already behind the walls, but people who are awaiting trial? Most people wouldn’t think about this. You have a constitutional right to a speedy trial. If the court system is on hold, then what happens to you while you await a hearing or a trial? The court COULD send you home under home confinement. They could use some technology to monitor you. There are many things that could be done if they wanted to. And by proxy, if we wanted them to. Elections have consequences. Not just at the top, but at all of the various stages below. This is a reflection of us.
